Terms of Purchase
1. GENERAL PROVISIONS
1.1 These terms and conditions of sale (hereinafter "Terms") of the Hobimaailm online store (hereinafter "e-shop") apply to purchases made from the Hobimaailm e-shop at the Internet address http://www.hobimaailm.ee. The seller of the goods is OÜ Hostel (hereinafter: "Seller"), address Paldiski mnt 102, Tallinn 13522, registry code 11337837, e-mail address info@hobimaailm.ee. The Terms apply to all legal relationships arising between any person (hereinafter: "Client") and the Seller upon purchasing goods through the Hobimaailm e-shop.
1.2. The Seller has the right to unilaterally amend and supplement the Terms by publishing the new Terms at the Internet address http://www.hobimaailm.ee/et/p/ostu-tingimused. If the Client submitted an order before the entry into force of the amendments to the Terms, the Terms in force at the time of submitting the order shall apply to the legal relationship between the Client and the Seller.
1.3. The Client has the opportunity to save, print and, if necessary, reproduce the Terms before making a purchase, and the Client agrees to the provisions of the Terms when making a purchase from the e-shop.
1.4. In addition to the Terms, the legislation in force in the Republic of Estonia shall apply to making purchases from the e-shop.
2. PLACING AN ORDER
2.1. The Client selects the desired goods from the e-shop and adds them to the shopping cart.
2.2. The Client chooses the method and place of delivery of the order.
2.3. The Client confirms the shopping cart and pays for the goods in the payment environments offered by the Seller. Before paying the invoice, the Client checks that the information provided in the invoice corresponds to the Client's actual wish.
2.4. After paying for the goods, the Client must click on the link "Back to the merchant".
2.5. The Seller shall send a confirmation and invoice to the Client by e-mail regarding the receipt of the order and payment.
2.6. The sales contract between the Seller and the Client enters into force from the moment the purchase amount paid by the Client is received in full to the Seller's bank account.
3. PRICE OF GOODS AND PAYMENT OPTIONS
3.1. All prices of goods sold in the Hobimaailm e-shop are shown in euros and include 22% VAT.
3.2. The Client shall pay the selling price of the goods and the delivery fee in full as an advance payment for the order. Payment is made outside the e-shop in a secure environment - when paying by bank link, in the secure environment of the respective bank, and when paying by credit card, in the secure environment of Maksekeskus AS. The Seller does not have access to the Client's bank and credit card details.
3.4. If the Client does not choose to pick up the ordered goods themselves, a delivery fee will be added to the selling price in accordance with clause 4 of the Terms of Sale.
3.5. The goods can be paid for in the ways indicated in the Hobimaailm e-shop web environment. A service fee may be added to the cost of the order in accordance with the agreement concluded between the Client and the bank or credit card issuer.
4. RECEIPT OF GOODS
4.1 Goods can be ordered to the Hobimaailm store, SmartPOST; Omniva parcel machine or to the address indicated by the Client using the Smartpost courier service.
4.2 Receipt of goods from the Hobimaailm store in Rocca al Mare center, Paldiski mnt 102, Tallinn.
4.2.1. The goods are issued during the opening hours of the Hobimaailm store.
4.2.2. The goods will be issued to the Client upon presentation of an identity document (ID card, passport, driver's license) and order number. In the absence of an identity document, the Seller may refuse to issue the goods.
4.2.3. The Seller is not liable for any damage caused to the Client if, for reasons not attributable to the Seller, third parties have obtained a copy of the invoice or a unique order number and the goods have been received on the basis thereof.
4.2.5. When ordering goods for receipt from the Hobimaailm store in Rocca al Mare center, no delivery fee is added to the amount.
4.3. Receiving goods from a parcel machine
4.3.1. When delivering the goods to the SmartPOST or Omniva parcel machine chosen by the Client, a delivery fee will be added to the price of the goods.
4.3.2. Ordered products arrive in Estonia within 1-3 working days. Goods usually arrive abroad within 1-2 weeks, depending on the distance of the country. NB! Customs duties and time-consuming customs procedures may apply in non-EU countries. NB! Please note that delivery may take longer during public holidays. We apologize for any inconvenience! In the case of international shipments, the delivery speed depends on the transport company and customs procedures and can take up to 30 days, although the usual delivery time has not exceeded 1-2 weeks according to our data.
4.3.3. The Client will be notified of the arrival of the goods at the parcel machine by an SMS message, which contains a unique door code to open the parcel machine door.
4.3.4. The Seller is not liable for any damage caused to the Client if, for reasons not attributable to the Seller, third parties have obtained the unique code of the parcel machine and the goods have been received on the basis thereof.
4.4. Receiving goods by courier
4.4.1. When choosing Smartpost courier for delivery of the goods, a delivery fee will be added to the price of the goods.
4.4.2. Goods purchased from Monday to Thursday and delivered by courier will be delivered by courier to the address indicated by the Client on the day following the purchase between 10.00 and 21.00. Goods purchased from Friday to Sunday will be delivered by courier to the address indicated by the Client no later than the following Monday between 10.00 and 21.00. The exact time of delivery of the goods will be agreed in advance by the courier with the Client by phone.
4.4.3. The Client must ensure the receipt of the goods at the agreed time and address.
4.5. Checking the goods
4.5.1. Upon receipt of the goods, the Client undertakes to open the product packaging carefully, without damaging the packaging and products. If the Client has damaged the packaging due to negligence, i.e. it was possible to open the product packaging without damaging it, the Seller has the right to demand compensation for the damage caused upon return of the goods. If the product packaging cannot be opened without breaking/breaking, the Client is not responsible for the damaged packaging.
4.5.2. If the Client discovers upon receipt of the goods that they have been sent incorrect or defective goods or the goods do not reach the Client in good condition and in closed packaging, the Seller must be informed immediately.
4.5.3. The Seller is responsible for the goods purchased by the Client during its transportation. The risk of damage or loss of the goods passes to the Client from the moment of receipt of the goods.
5. PROCESSING OF CLIENT'S PERSONAL DATA
5.1. The Seller uses the personal data provided by the Client and data about purchases made in accordance with the Personal Data Protection Act to the extent necessary to fulfill the order placed by the Client in the e-shop. The Seller shall not transfer the Client's personal data to third parties, except to the company providing the postal or courier service to the extent necessary to deliver the goods to the Client.
5.2. The Seller does not have access to the Client's bank details when paying for the goods via the Internet bank.
6. RETURN OF GOODS, WITHDRAWAL FROM THE CONTRACT AND REFUNDS
6.1. The Client has the right to withdraw from the contract without giving a reason within 14 calendar days from the receipt of the goods (receipt of the notification of arrival of the goods to the SmartPOST/Omniva parcel machine, except in the event of defects in the product, see clause 7).
6.2. To return the goods, the Client must fill in the return part of the invoice-delivery note that came with the goods or the withdrawal application and forward it together with the goods to Hobimaailm (place of business Rocca al Mare keskus, Paldiski mnt 102, Tallinn).
6.3. When exercising the right of withdrawal, the Client is obliged to return the goods to the Seller no later than 14 days from the submission of the withdrawal application.
6.4. The Client may exercise the right of withdrawal if the goods are unused and undamaged. We recommend that the Client send back or deliver all the goods they wish to return at once. The direct costs related to the return shall be borne by the Client. We recommend returning the goods in their original transport packaging.
6.5. According to the Law of Obligations Act, the right of withdrawal does not apply to goods that cannot be returned due to their nature. Returns are only accepted together with a completed withdrawal application.
6.6. If the Client has withdrawn from the transaction, the Seller shall return to the Client the purchase amount together with the delivery fee immediately, but not later than 14 calendar days after the withdrawal application reaches the Seller. The refund will be made to the same bank account from which the purchase was paid.
6.7. In the event that the Client has deliberately or negligently damaged or damaged the returned goods, the Seller has the right to refuse to accept the goods back or to demand compensation for the damage caused.
7. SUBMISSION OF CLAIMS AND LIABILITY
7.1. The seller is liable for the non-conformity of the purchased goods for 2 years from the delivery of the goods to the Client. In the case of the sale of goods to a consumer, it is assumed that the non-conformity to the terms of the contract that appeared within 6 months from the date of delivery of the goods to the Client existed at the time of delivery of the item, unless such an assumption is contrary to the nature of the item or defect. The Client undertakes to inform the seller of the non-conformity of the goods no later than 2 months after its discovery, i.e. to submit a claim.
7.2. The Client is recommended to submit a claim by e-mail to info@hobimaailm.ee or to the Hobimaailma store (place of business Rocca al Mare keskus, Paldiski mnt 102, Tallinn) customer service representative. The claim must indicate the Client's name and contact details, the date of submission of the claim, the defect that appeared in the goods and the content of the claim, and a document proving the purchase must be attached.
7.3. The seller is not responsible for any damage or any other consequences arising from incorrect data provided by the Client when fulfilling the order, including delay in delivery, if this is due to circumstances that the seller could not influence.
7.4. The seller is not responsible for damages caused by improper use of the ordered goods.
7.5. Disputes arising between the seller and the Client shall be resolved by the parties through negotiations. If no agreement is reached, the Client has the right to contact the Consumer Protection Board (Rahukohtu 2 Tallinn 10130, http://www.tarbijakaitseamet.ee) and the Consumer Disputes Committee (Rahukohtu 2 Tallinn 10130, http://www.komisjon.ee) for out-of-court settlement of the dispute or Harju County Court. In addition, the European Union's electronic environment ODR platform (Online Dispute Resolution) is open to all clients to resolve complaints with e-traders at http://ec.europa.eu/odr.
How to buy from the e-shop
Select a product. Save it to your shopping cart. When paying for the shopping cart, choose the delivery method, pay for the goods via bank link or credit card and after paying, be sure to click on the link "Back to the merchant". An invoice will be sent to your e-mail address to confirm your purchase.
